I. Terms of account use:

1. To use the service, you must be 13 years of age or older.

2. Provide a valid email address and other information as required to complete the registration process.

3. You are responsible for keeping your account and password secure. MITEK  cannot and will not be liable for any loss or damage arising from your failure to keep your account information secure.

4. It is strictly forbidden to transmit any viruses or malicious code of a destructive nature.

5. In case you violate the service regulations as well as the service support system, we have the right to restrict or disable your access and use of the service without notice.

6. Violation of any of the Terms of Account Use, MITEK  will immediately terminate your services.

II. General conditions:

You agree to use the Service only for your personal or commercial purposes as an online support solution. MITEK  strives to protect your personal information and privacy, however we cannot guarantee the security of any information you disclose online. By agreeing to this Agreement, you acknowledge that certain limitations of it. By using the Service, you agree to the following:

1. Provide truthful, accurate and complete information as required by MITEK .

2. You may not transfer, assign, license or resell the service, in whole or in part, unless you are an authorized partner of MITEK . In the case of a partner who has signed a “Commitment to cooperate with MITEK “, allowing a third party not included in the commitment to illegally use the service is a breach of contract and is strictly prohibited.

3. Your content (not including credit card information), may be transferred unencrypted due to (a) transmissions over various networks; and (b) changes in connecting devices and networks to conform and adapt to technical requirements. Credit card information is always encrypted during transfer over networks.

4. We may, but have no obligation to, remove content and accounts containing content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.

5. In the case of products, services, information or other documents purchased, sold, transmitted through the use of MITEK services  or products not owned by MITEK , we will not be responsible or guarantee the quality.

6. You expressly understand and agree that MITEK  shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the MITEK service .

7. Verbal or written abuse of any kind (including threats of abuse or retaliation) towards any MITEK customer, employee, or member will result in immediate account termination.

III. Fees:

Subject to the terms and conditions of this Agreement, MITEK  grants you a limited, non-exclusive, non-transferable license to use the Service solely for the purpose of providing the Service in accordance with the terms of this Agreement during its term. By using the Service, you agree not to violate any of the following terms:

1. Copy or translate MITEK’s content and source code .

2. Combine the use of MITEK ‘s translation with another program.

3. You may not modify, reverse engineer, disassemble or otherwise copy, or create derivative works of, the Service or the Service website.

4. Rent, sublicense or lease any part of the Service, unless you act as an authorized partner of MITEK .

5. Use the Service for unauthorized commercial purposes or for purposes other than those set forth in this Agreement, unless you do so as an authorized partner of MITEK  pursuant to your Partner Agreement.

6. Cause trouble, threat, harassment or discomfort to any visitor, or any other person or entity.

7. Sending spam emails with a link to MITEK  or MITEK’s website .

8. Impersonate any person or entity or represent MITEK  to any other person or entity.

9. Use MITEK ‘s embed code  on websites or email campaigns to generate more than 1,000,000 visits per month or more than 100 concurrent visitors at any one time, unless otherwise  authorized in writing by MITEK .

10. If you violate the above terms, we reserve the right to unilaterally terminate your limited license without prior notice.

IV. Limitation of liability:

The Service is provided on an “as is” and “as available” basis, MITEK  makes no warranties of any kind, either expressed or implied, including but not limited to:

1. Warranties of title, non-infringement, merchantability or fitness for any particular purpose, regarding the availability, accuracy, stability, information or content of the Service.

2. Any warranties of merchantability or fitness for a particular purpose. You agree and acknowledge that your use of the Service is at your sole risk. This disclaimer applies to any damages or injury caused by the Service, including but not limited to any failure of performance, error, omission, interruption, deletion, delay or failure in operation or transmission. Any computer virus, transmission line failure, theft, destruction or unauthorized access.
Any material downloaded or otherwise obtained through the use of the Service, you agree and acknowledge that such is at your own risk, and that you shall be solely responsible for any damage to your computer system.
No advice or information, whether oral or written, from MITEK or through any form of MITEK service  shall constitute a warranty for the matters mentioned above in the terms.

V. Limitation of liability:

You expressly understand and agree that in no event shall MITEK  and its affiliates, agents, directors, consultants, employees, support staff, partners be liable to anyone for any indirect, direct, incidental, special or consequential damages (including loss of profits, interruption of use and transmission of data and the like (even if MITEK has been advised of such damages). You also agree that in no event shall MITEK  be liable for damages exceeding the total monthly service fee. In the event that the service is provided free of charge, MITEK  shall have no liability to you.

VI. Content limitations:

You expressly understand and agree that in no event shall MITEK and its affiliates, agents, directors, consultants, employees, support staff, partners be liable to anyone for any indirect, direct, incidental, special or consequential damages (including loss of profits, interruption of use and transmission of data and the like (even if MITEK has been advised of such damages). You also agree that in no event shall MITEK be liable for damages exceeding  the total monthly service fee. In the event that the service is provided free of charge, MITEK shall have no liability to you.

1. Display or promote obscene, indecent, pornographic information or promote sexually explicit conduct.

2. Promotes abusive, threatening, hateful, harassing, libelous, or violent behavior.

3. Infringement of third party intellectual property rights.

4. Provide false, misleading or inaccurate information.

5. Hack or modify the Services in a manner inconsistent with MITEK’s intent.

6. Disclosing or hacking personal login information, including, but not limited to, passwords, without the permission of the individual or entity that provided it to you.

7. Transmit viruses or malware

8. Sending junk mail, unwanted mail or spam

9. Collecting users’ personal information or content through the use of MITEK  and automated services or means without our permission.

10. Promote, endorse, distribute, publish, or send any material to embezzle, fraudulently solicit funds from visitors through the use of MITEK’s services. Unfortunately, we cannot currently control all content posted by third parties using the service, nor do we have an obligation to monitor the Service, so we do not guarantee the accuracy, integrity or quality of that content.

However, we ensure that in no case will MITEK be liable for any content, including any errors or omissions in the content, or any loss or damage of any kind incurred as a result of MITEK itself . You also agree that you must evaluate and bear all risks associated with the use of the content, its integrity, and accuracy.

VII. Third-party services:

You may allow third parties to access your account to obtain additional products, services or labor, but you acknowledge and agree that you are solely responsible for the actions of such third parties and are bound by such third parties’ terms.

VIII. Account Termination:

1. You may cancel or terminate your account at any time. Closing your account means that your continued use of the service with the same account and password will no longer be valid.

2. You are solely responsible for unilaterally terminating your account. MITEK  is not responsible for any payment for premature termination of the account.

3. MITEK  reserves the right to modify or terminate current or future services for any reason, at any time.

4. Without limiting any other remedies, MITEK  may suspend or terminate your account for your violation of the provisions of these terms and conditions or unauthorized use of the services provided.

IX. Compensation:

By using the service, you agree to indemnify and hold harmless MITEK ‘s employees, directors, agents and third parties or reputation , from any claims, proceedings for losses, costs, liabilities (including usage costs and attorneys’ fees) related to or arising from your connection to or use of the services, including but not limited to your violation of the Terms and claims arising from content you submit, post, transmit when using the Service.
